Information sheet within the frame of the collection of data from a data subject as referred to in Article 13 GDPR

We process your personal data exclusively within the frame of the regulations of the General Data Protection Regulation (GDPR) as well as the Austrian Datenschutzgesetz.

Collecting and processing data

We process those personal data that we receive from you as a customer in the course of an inquiry, order or registration at our WEB-Shops respectively when a contract is concluded. The data are processed in order to handle the contract. The legal basis is Article 6 paragraph 1 b GDPR:

  • processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract; 

Your personal data will not be passed on to third parties other than our processors. 

As far as the storage period for data needed for the initiation and fulfillment of a contract is concerned, we are subject to the regulations of § 105 (1) Bundeshaushaltsgesetz, which gives a period of 7 years. 

As far as the charges (Gebühren) are concerned we process your personal data, which you provide as applicant in an official administrative procedure. Here the legal basis for data processing is

  • Article 6 Paragraph 1 c GDPR: processing is necessary for compliance with a legal obligation to which the BEV is subject; 

The obligation to charge (Gebühren) is based on different sources 

  • § 47 Vermessungsgesetz, BGBl. Nr. 306/1968, in the current version together with the Vermessungsgebührenverordnung 2016, BGBl. II Nr. 320/2016, in the current version 
  • § 57 Maß- und Eichgesetz, BGBl. Nr. 152/1950, in the current version together with the Eichgebührenverordnung 2013, BGBl. II Nr. 311/2013, in the current version 
  • Gerichtsgebührengesetz, BGBl. Nr. 501/1984, in the current version
  • Gebührengesetz 1957, BGBl. Nr. 267/1957, in the current version 

Your personal data will not be passed on to third parties other than our processors.

Your rights

These are your rights concerning your personal data:

Right of access by the data subject (Article 15 GDPR) 

The data subject shall have the right to obtain from the BEV confirmation as to whether or not personal data concerning him or her are being processed, and, to which extent.

Right to rectification (Article 16 GDPR) 

The data subject shall have the right to obtain from the BEV without undue delay the rectification of inaccurate or incomplete personal data concerning him or her. 

Right to erasure (Article 17 GDPR) 

The data subject shall have the right to obtain from the BEV the erasure of personal data concerning him or her without undue delay if the personal data have been unlawfully processed or the processing interferes disproportionately with the justified interests of the data subject. Please bear in mind, that there can be reasons against the immediate right to erasure e.g. in case of statutory storage obligations.

Right to restriction of processing (Article 18 GDPR) 

The data subject shall have the right to obtain from the BEV restriction of processing under certain conditions. Those conditions are listed in Article 18 of the GDPR. 

Right to data portability (Article 20 GDPR) 

1. The data subject shall have the right to receive the personal data concerning him or her, which he or she has provided to the BEV, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from the BEV, where technically feasible insofar as the processing of the personal data relies on consent or it is necessary for the performance of a contract.

Right to object (Article 21 GDPR) 

The data subject shall have the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her which is based on point (e) or (f) of Article 6 (1), including profiling based on those provisions.

Right to lodge a complaint with a supervisory authority (Article 77 GDPR) 

Without prejudice to any other administrative or judicial remedy, every data subject shall have the right to lodge a complaint with a supervisory authority, in particular in the Member State of his or her habitual residence, place of work or place of the alleged infringement if the data subject considers that the processing of personal data relating to him or her infringes the GDPR. 

Confirmation of your identity: 

In case of doubt we can request additional information to confirm your identity. This serves to protect your right to privacy.

Safety information

We use Cookies to be able to continuously identify a user during a browser session. Thus the users can move freely on the website without losing data. The Cookies are removed from the computer at the end of the browser session. 

We use the Secure Socket Layer (SSL)-Protocol for registration and login, for processing customer and user data and for paying with credit card. This protocol encrypts the data during the transfer from the user’s computer to the BEV-Server in order that third parties are not able to read these data. The BEV-Server was certified by VeriSign. 

To find the protected area on the BEV-Portal please click into the frame, where the data are entered. In the frame features (right mouse button) you will recognize the protected area by the address because it begins with https:// instead of http://. 

Here you can also click "Zertifikate" and have a closer look at the security certificates. The certificate has to be owned by the BEV, issued by VeriSign and it has to be valid. 

SIX Payment Services does the credit card clearing. 

To be able to provide all functions of the BEV - Transformator we use the Cookies and the LocalStorage of your browser. The LocalStorage is used to store personal data (dot list) at the browser of the user. The data remain local and are not used by the BEV.
